PRODUCTS AND ARTWORK

We take reasonable care to describe and display each artwork accurately.

Colours and textures may appear slightly different depending on lighting, photography and screen settings. Any material variation associated with handmade or hand-finished work will be explained on the product page.

The dimensions, materials, framing and edition information applicable to an artwork will be stated in its product description.

Placing an artwork in a standard frame after purchase does not make it a personalised product.

ORDERS

An order is an offer to purchase a product. A binding contract is formed when we send confirmation that we have accepted your order.

If we cannot accept an order, we will notify you and refund any payment received.

We may decline or cancel an order where:

• the product is unavailable;
• the price or description contained an obvious error;
• payment cannot be authorised;
• we cannot deliver to the address supplied; or
• we reasonably suspect fraud or unlawful activity.

PRICES AND PAYMENT

Prices are shown in pounds sterling and include VAT where applicable.

Any delivery charge will be displayed before you complete payment.

Payment must be made using one of the payment methods offered at checkout.

DELIVERY

Processing times and estimated delivery times are set out in our Shipping Policy and on relevant product pages.

We are responsible for the product until it is delivered to you or to a person you have nominated to receive it.

OWNERSHIP

You own the physical artwork after we have received payment in full and it has been delivered to you.

Purchasing an artwork does not transfer copyright or reproduction rights.

CANCELLATIONS, RETURNS AND REFUNDS

Your cancellation and return rights are explained in our Returns and Refunds Policy, which forms part of these terms.

For eligible online purchases, you may cancel without giving a reason from the time of ordering until 14 days after receiving the product.

Standard framed, printed-to-order or hand-embellished products remain eligible for cancellation unless they have been clearly personalised to your individual requirements.

COMMISSIONED OR PERSONALISED ARTWORK

Where you commission artwork or request genuine personalisation, we will agree the specification, price and estimated timescale with you before the work begins.

The statutory cancellation right may not apply to products made to your individual specifications or clearly personalised for you. Where this exception applies, we will tell you before you place the order.

FAULTY OR MISDESCRIBED PRODUCTS

Products must be of satisfactory quality, fit for their normal purpose and as described.

If a product is damaged, faulty or not as described, please contact us. Nothing in these terms limits your rights under the Consumer Rights Act 2015 or other applicable consumer law.

INTELLECTUAL PROPERTY

All artwork, photographs, text, designs and other original content on this website remain the intellectual property of Sarah Pittaway or their respective owner.

You may not reproduce, publish, distribute, commercially exploit or create reproductions from the artwork or website content without prior written permission.

LIABILITY

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or breach of your statutory consumer rights.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made wholly or mainly for personal use.

PERSONAL INFORMATION

We process personal information in accordance with our Privacy Policy.

CHANGES TO THESE TERMS

The terms applying to your purchase are those in force when your order is placed.

We may update these terms for future orders. Changes will not retrospectively alter a contract already made with you.

GOVERNING LAW

These terms are governed by the law of England and Wales.

If you live elsewhere in the United Kingdom, you retain the benefit of any mandatory consumer protections applying where you live.

You may bring legal proceedings in the courts applicable to your place of residence.
